9. Notice and Opportunity to Resolve Before Filing Suit
Before starting any lawsuit or other formal proceeding against Summit Tool & Forging relating to the Website, you agree to first send written notice of your claim to bgraham@kentool.com or 768 E. North St., Akron, OH 44305, describing the issue and the relief you are seeking. You agree to give Summit Tool & Forging at least sixty (60) days to review and attempt to resolve the matter informally. You may not file suit until this period has passed. This requirement does not prevent either party from seeking urgent injunctive relief where necessary.
10. Class Action Waiver
To the fullest extent permitted by law, you and Summit Tool & Forging agree that any dispute relating to the Website will be brought only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. You waive any right to participate in a class action against Summit Tool & Forging relating to your use of the Website.
11. Changes to These Terms
We may update these Terms from time to time. Changes take effect when we post the revised Terms and update the “Effective Date” above. Your continued use of the Website means you accept the updated Terms.
12. Severability and Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. These Terms, together with the Privacy Policy, are the entire agreement between you and Summit Tool & Forging regarding the Website.
